1. Acceptance of Terms

By accessing or using ScoopPro Smart CRM services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Services.

2. Description of Services

ScoopPro Smart CRM provides customer relationship management software and related services for pet waste removal businesses, including customer management, appointment scheduling, payment processing, and SMS/email communications.

3. User Accounts

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate and complete information when creating your account
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

4. SMS Terms and Conditions

By opting in to receive SMS messages from ScoopPro Smart CRM or its users, you agree to the following:

  • Consent: You consent to receive automated text messages at the phone number provided, including appointment reminders, service notifications, and payment reminders.
  • Message Frequency: Message frequency varies based on your service schedule and account activity.
  • Costs: Message and data rates may apply. Check with your mobile carrier for details.
  • Opt-Out: You may opt out at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent.
  • Help: Reply HELP to any message for assistance, or contact us directly.
  • Carriers: Supported carriers include major US carriers. Carriers are not liable for delayed or undelivered messages.

5. Acceptable Use

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Send unsolicited or unauthorized messages (spam)
  • Infringe on the rights of others
  • Transmit malicious code or interfere with the Services
  • Attempt to gain unauthorized access to any systems
  • Use the Services for any fraudulent or deceptive purposes

6. Billing, Card on File, and Automatic Upgrades

Creating an account requires a valid payment card, saved securely with our payment processor (Stripe). Nothing is charged when you sign up: the Free plan is free for up to 15 customers and the free monthly texting allowance shown on our pricing page.

Automatic upgrade. If your account exceeds either Free limit — more than 15 customers, or more than the free monthly texting allowance — the Premium plan ($47 per month, billed monthly) starts automatically on the card on file, and you consent to that charge when you save your card. We email you before you reach a limit and again when Premium starts. You may cancel Premium at any time from Settings → Billing; cancellation takes effect at the end of the current billing period and your account returns to the Free plan and its limits.

Refunds. Subscription charges are non-refundable except where required by law or at our discretion; contact support within 14 days of a charge you believe was made in error.

Customer payments. Card payments you collect from your own customers through the Services are processed through your connected Stripe account, where you are the merchant of record. Those payments are between you and your customer, are subject to Stripe's terms and standard processing rates, and carry no additional ScoopPro Smart CRM platform fee.

7. Intellectual Property

All content, features, and functionality of our Services are owned by ScoopPro Smart CRM and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOOPPRO SMART CRM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify and hold harmless ScoopPro Smart CRM and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
